Professional tax is a state subject, so it exists in some states and not others. Levying states include Maharashtra, Karnataka, West Bengal, Tamil Nadu, Gujarat and Telangana, among many. States like Delhi, Haryana, Uttar Pradesh and Rajasthan do not levy it at all. Here is what to check for your state.
What professional tax is
Professional tax is a small state-level tax on employment, professions and trades, capped by the Constitution at Rs 2,500 per person per year. Employers deduct it from salaries and deposit it, and also pay their own enrolment liability. The slabs and due dates are set by each state.
States that levy it
Many states charge professional tax, including Maharashtra, Karnataka, West Bengal, Tamil Nadu, Gujarat, Telangana, Andhra Pradesh, Madhya Pradesh, Kerala, Assam, Odisha, Bihar and several others. In some, like Tamil Nadu and Kerala, it is administered by local bodies rather than a single state slab.
States that do not
Several states and all union territories do not levy professional tax. These include Delhi, Haryana, Uttar Pradesh, Rajasthan, Uttarakhand, Himachal Pradesh, Goa and Arunachal Pradesh, among others. If you operate only in these, there is simply nothing to register or deposit.
PTRC and PTEC
In levying states, the PTRC (Registration Certificate) lets you deduct and deposit professional tax from employee salaries, while the PTEC (Enrolment Certificate) covers the business or professional own liability. Employers with staff typically need both.
